2. What are cookies?

4. Social media plug-ins

4.1. We use social media plug-ins on our website. To increase the protection of your data when you visit our website, these social media plug-ins have restrictions placed on them and are integrated into the site solely by using an HTML link. This integration ensures that a connection is not made to the servers of the respective social network’s provider when you access a page on our website containing the plug-ins. 5. Data transfer to countries outside of the EU/EEA

5.1. Your personal data may be transferred to countries that are outside of the European Union (EU) and European Economic Area (EEA) and offer an adequate level of data protection as set out in the European Commission adequacy decisions (https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en).


5.2. Your personal data is only transferred to countries which are not part of the EU/EEA and do not ensure an adequate level of data protection when the data controller and recipient of the data have concluded the European Commission’s standard contractual clauses (SCCs) as a reasonable guarantee for the protection of your personal data and have implemented supplementary security measures or you have given your express, voluntary consent.


6. How do we protect your data?

6.1 We take efforts to make your visit and use of our website as secure as possible. For that reason, we have taken corresponding technical and organisational measures within the meaning of GDPR Art 32 to ensure the confidentiality and security of your personal data.


7. Your rights as a data subject

7.1. As a data subject, you can exercise your rights in connection with the data processing outlined here. These rights are provided in the applicable legislation governing the protection of personal data:

To obtain confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, access to the personal data and connected information (including in particular on the purposes of the processing; the categories of personal data concerned; the recipients or categories of recipient to whom the personal data has been or will be disclosed; the period for which the personal data will be stored or the criteria used to determine that period; the existence of the right to rectification or erasure of personal data or restriction of processing of personal data or to object to such processing; the right to lodge a complaint with a supervisory authority; the source of the data; the existence of automated decision-making, including profiling, and, in those cases, meaningful information about the logic involved as well as the significance and the envisaged consequences of such processing for the data subject; the appropriate safeguards in the event that personal data is transferred outside of the EU/EEA; and a copy of the personal data undergoing processing where this does not adversely affect the rights and freedoms of others (right of access, GDPR Art 15).


7.3. To obtain the rectification of your personal data, i.e. correction, alteration or updating of inaccurate or no longer applicable data, and to have incomplete personal data completed, including by means of providing a supplementary statement (right to rectification, GDPR Art 16).


7.4. To obtain the erasure of personal data, in particular when it (i) is no longer necessary in relation to the purposes for which it was collected or otherwise processed, or (ii) has been unlawfully processed, or (iii) has to be erased for compliance with a legal obligation, or lastly (iv) you object to the processing (see "Right to Object" below) and there are no overriding legitimate grounds to allow the controller to continue processing the data in any instance (right to erasure, GDPR Art 17). In particular, data cannot be erased when the processing is necessary for compliance with a legal obligation or for the establishment, exercise or defence of legal claims before a court.


7.5. To obtain restriction of the processing of your personal data, i.e. the controller stores this data without being able to use it. In particular, this right can be exercised when (i) the accuracy of the personal data is contested, for a period enabling the controller to verify the accuracy of the personal data, or (ii) the processing is unlawful, and restriction of the data’s use is requested instead of its erasure, or (iii) the controller no longer needs the personal data for the purposes of the processing, but it is required by the data subject for the establishment, exercise or defence of legal claims, or (iv) you have objected to processing (see "Right to Object" below) pending the verification whether the legitimate grounds of the controller override those of the data subject (right to restriction of processing, GDPR Art 18).


7.6. To have the personal data that is processed based on your consent or a contract saved in a commonly used format and, where technologically possible, transmitted directly to a third party specified by you (right to data portability, GDPR Art 20).


7.7. Consent that has been given can be withdrawn at any time without giving reason and with effect for the future, for example, by emailing contact@colmobil.at. (right to withdrawal of consent, GDPR Art 7(3)).


7.8. Furthermore, as a data subject, you have a right to object (GDPR Art 21): to object to direct marketing initiatives and, on grounds relating to your particular situation, at any time to processing of your personal data for the purpose of entering into or performing a contract between us and the provider. In this case, the controller will refrain from processing your personal data further unless it demonstrates compelling, legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or the processing is for the establishment, exercise or defence of legal claims.

8. Changes

8.1. The ongoing enhancement of our activities may result in changes in the characteristics of the above processing of your personal data.
